Take part in Brodie Illuminated 2024

Entering the competition

1. Brodie Castle’s Playful Memories competition for Brodie Illuminated 2024 (the ‘competition’) is open to everyone (you).

2. To enter the competition, you should submit a photograph that represents playful memories that you have experienced at Brodie Castle.

3. You can enter the competition by sending your entry to competitions@nts.org.uk. You are responsible for the process of submitting your competition entry to us.

4. If you are selected as a winner, then you must pass to us your name, address, email address and contact telephone number of you or (if you are under 18) your parent or guardian. We will only use this information in relation to the competition and will not use it for any other purposes whatsoever. We will not keep this information for longer than is necessary for the operation of the competition. All personal data will be processed in accordance with the Trust’s Privacy Policy.

5. You can submit multiple entries to the competition.

6. We must receive your entry to the competition by 11.59pm on Sunday 27 October 2024.

Picking the winners

7. A panel of judges from the Trust will, at their sole discretion, pick the winners.

8. The winning entries will be those which the panel considers to best represent the theme of playful memories experienced at Brodie Castle.

9. The panel’s decision will be made on or before Monday 28 October 2024. The decision of the panel is final and no correspondence will be entered into.

Publishing the winning entries

10. The winning entries will be displayed during the Brodie Illuminated 2024 event, which runs from 1 November–24 November 2024, and may be published by the Trust on its website or other media (including print and digital media).

11. You own the copyright to your competition entry as its author.

12. By submitting an entry to the competition, you give the Trust permission for your entry to be published by the Trust in any media and grant the Trust a non-exclusive, royalty-free, worldwide licence to republish your competition entry in electronic format and hard copy for purposes connected with the competition, or the Trust, or the promotion of the Trust’s charitable purposes.

Getting consent from an adult

13. Sending in an entry to the competition means that you accept these Terms and Conditions, which are the rules of the competition. If you are under the age of 18, you should check with your parent or guardian that they are happy for you to enter the competition based on these Terms and Conditions.

14. Where the author is under the age of 18, the Trust requires the consent in writing (which may include email) of the parent or guardian of the author of a winning entry to publish that winning entry and the author’s name, age and town/city of residence.

15. If the Trust does not receive written consent (which may include email) from the parent or guardian of an author under the age of 18, then we may award the prize to another entry for which we are able to gain such consent.

The prizes

16. The winner will have their photo displayed during the Brodie Illuminated 2024 event, along with other winners of the competition.

17. If a winner does not provide the necessary information set out in clause 4 within 7 days, the Trust may select another winner.

Data protection

18. Please ensure that the photograph you send is your own. If you are submitting photographs of children, we must have written permission from a parent or guardian of every child featured (a grandparent, auntie or friend will not suffice). In contributing to the National Trust for Scotland you agree to grant us a royalty-free, non-exclusive licence to publish and otherwise use the material in any way, including in any media worldwide. However, you will still own the copyright to everything you contribute to the National Trust for Scotland. At no time should you endanger yourself or others, take any unnecessary risks or infringe the law.

Other rules

19. Entries must be your original and you will indemnify the Trust for and against all liabilities, costs, expenses and damages incurred by the Trust as a result of any breach of any third party’s copyright arising from the publication or use of the work by the Trust.

20. We take no responsibility for entries that are lost, delayed, incomplete or cannot be uploaded or submitted for any technical or other reason.

21. No purchase is necessary.

22. The promoter of the competition is the National Trust for Scotland, Hermiston Quay, 5 Cultins Road, Edinburgh EH11 4DF. Any complaints regarding the competition should be sent to this address.

23. Nothing in these Terms and Conditions shall exclude the liability of the Trust for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.

24. The Trust accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the competition or accepting the prize. The Trust further disclaims liability for any injury or damage to you or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the competition.

25. The Trust reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, this competition with or without prior notice. The decision of the Trust in all such matters is final and binding.

26. The Trust shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

27. The competition will be governed by Scots law.
